1. Overview
Sentus AI respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines our procedures for responding to claims of copyright infringement in accordance with 17 U.S.C. § 512.
2. Copyright Infringement Notification
2.1 Filing a DMCA Takedown Notice
If you believe that content on our platform infringes your copyright, please send a written notice to our Designated Copyright Agent containing the following information:
- Physical or electronic signature of the copyright owner or person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
- Identification of the infringing material including URL or other location on our platform
- Your contact information including name, address, telephone number, and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

3. Counter-Notification Procedures
3.1 Filing a Counter-Notice
If you believe your content was removed by mistake or misidentification, you may file a counter-notification containing:
- Your physical or electronic signature
- Identification of the removed content and its location before removal
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to jurisdiction of the Federal District Court for your judicial district (or if outside the US, any judicial district in which Sentus AI may be found)
- A statement that you will accept service of process from the complainant or their agent
3.2 Counter-Notice Processing
Upon receipt of a valid counter-notice:
- We will forward the counter-notice to the original complainant
- We will inform the complainant that we will restore the content in 10-14 business days
- Content will be restored unless the complainant files a court action seeking an injunction
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Sentus AI has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.
- First Offense: Warning and temporary content removal
- Second Offense: Temporary account suspension (7-30 days)
- Third Offense: Permanent account termination
5. User-Generated Content
Users are solely responsible for the content they upload or create using our platform:
- Property descriptions and marketing materials
- Photos and videos of properties
- Custom AI training data or prompts
- Communications and messages
Users must have rights to all content they upload and must not infringe third-party intellectual property.
6. Safe Harbor Provisions
Sentus AI qualifies for DMCA safe harbor protections under 17 U.S.C. § 512(c) as a service provider that:
- Does not have actual knowledge of infringing activity
- Does not receive financial benefit directly attributable to infringing activity
- Responds expeditiously to remove or disable access upon notification
- Has designated an agent to receive infringement notifications
- Accommodates and does not interfere with standard technical measures
7. Misrepresentations
Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that:
- Material is infringing, or
- Material was removed or disabled by mistake or misidentification
shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer or copyright owner as a result of our relying upon such misrepresentation.
8. Response Timeline
- Acknowledgment: Within 1 business day of receiving valid notice
- Investigation: 2-5 business days to review claim
- Action: Content removed or access disabled within 5 business days if infringement confirmed
- Notification: User notified of removal within 1 business day of action
9. International Copyright
While our primary compliance is with US copyright law, we also respect international copyright treaties and agreements, including:
- Berne Convention for the Protection of Literary and Artistic Works
- WIPO Copyright Treaty (WCT)
- EU Copyright Directive
